1. Scope
These terms apply to the use of the Discord bot “Plixy”, the website and the dashboard (together the “Service”), operated by Adrian Gerber (“we”). By adding the bot to a server or using the dashboard you accept these terms.
2. Service
The Service is provided free of charge without any guaranteed availability or feature set. We may change, limit or discontinue features at any time.
3. Your obligations
- Comply with Discord's Terms of Service and Community Guidelines and the applicable law.
- Do not distribute unlawful, offensive or infringing content through the Service.
- Do not abuse, overload or attack the Service, circumvent security measures or scrape it.
- Do not exploit security vulnerabilities; please report them to us confidentially.
4. Server administrators
- You are responsible for the configuration and the related data processing in your server (e.g. logs, tickets, retention).
- Inform your members about the bot, e.g. by referring to our Privacy Policy.
- Use automated moderation proportionately and allow affected members to request a review.
5. Content
Rights to content sent through the Service remain with their owners. You grant us the rights needed to technically provide the Service (e.g. storing ticket transcripts).
6. Suspension
If these terms are violated we may restrict or end the use of the Service for individual users or servers without notice.
7. Liability
We are only liable for damage caused intentionally or through gross negligence. Any further liability, in particular for data loss, lost profits, outages or actions of third parties (including Discord), is excluded to the extent permitted by law (Art. 100 Swiss Code of Obligations). Server administrators are responsible for actions they take with the bot.
8. Changes
We may change these terms. The new version applies once published on this page; continued use means acceptance.
9. Governing law and jurisdiction
Swiss law applies exclusively, excluding the CISG and conflict-of-law rules. Place of jurisdiction is, where legally permitted, the operator's domicile in Switzerland. Mandatory places of jurisdiction, in particular for consumers, remain reserved.
